The Health Insurance Portability and Accountability Act (HIPAA) ensures that your privacy is strictly protected from the moment you begin therapy. Under federal law, your therapist cannot disclose your attendance, session details, diagnoses, or personal health information to anyone—including employers, family members, or spouses—without your explicit written consent. HIPAA also creates a special tier of heightened privacy for a therapist’s private process notes, keeping them separate from general medical records so they cannot be accessed by third parties or insurance providers.
The only exceptions where a clinician is legally mandated to break confidentiality occur during immediate safety crises involving imminent risk of harm to self or others, suspected abuse of children or vulnerable adults, or under a direct court order issued by a judge.
